1. Eligibility
You must be at least 13 years old and located in the United States to use lowk. If the law where you live requires a parent or guardian to consent to an online service, you may use lowk only with that consent. You may not use lowk if we previously disabled your account for a serious or repeated violation unless we give you written permission.
Lowk supports both school communities and contacts-based play. You do not have to be enrolled in high school, but information you provide about your age, school, grade, identity, and account must be truthful. Location-based school suggestions are not proof of attendance.
2. Your account
You create and access an account through a verified phone number. You are responsible for your device, account activity, and maintaining access to that number. Do not impersonate another person, create deceptive accounts, evade restrictions, or let another person use your account. Tell us promptly if you believe your account has been compromised.
Some profile fields may have limits on how often they can be changed. A profile photo may be replaced, but it must comply with these Terms. Usernames are assigned subject to availability, safety restrictions, and our right to reserve or reassign names when reasonably necessary.
3. Friends, contacts, and communities
Adding an eligible person creates a reciprocal lowk friendship for both accounts; lowk does not use a pending approval queue. Removing or blocking someone ends the friendship. Unblocking does not restore it automatically, and temporary re-add limits may apply.
Contacts access is optional. If granted, lowk may privately match phone numbers made available by your device to identify existing users and help you choose someone to invite or nominate. You may use contact information only for people you actually know and only as permitted by law and these Terms. School discovery is limited to the community associated with your account; contacts and existing friendships may connect eligible people outside that community.
4. Polls, flames, and activity
Lowk presents curated questions with eligible people as choices. You may choose someone, use an available shuffle, skip, or—where offered—nominate an eligible contact. A registered user chosen in a poll may receive a flame. Contact placeholders do not receive a flame unless a supported nomination is later claimed after that person creates an eligible account.
Poll availability, round length, shuffle limits, cooldowns, eligibility, candidate ordering, and rewards are determined by lowk and may change to protect safety, fairness, reliability, or product quality. Do not automate votes, coordinate manipulation, create fake accounts, or interfere with candidate selection or rewards.
Activity shared with friends is intentionally limited and does not identify who cast a vote. You may hide supported activity through the settings available in the app.
5. Anonymity and reveal limits
Flames are displayed without the sender's name by default, but not every lowk interaction has the same reveal rules:
- An ordinary registered-user poll vote may be eligible for limited hints or a reveal.
- A vote sent using Ghost Mode is never identity-revealable.
- A nomination is never identity-revealable.
- A vote submitted through a public lowk link is never identity-revealable.
Lowk+ may show server receipt time, approximate city, region and country, and a coarse device category for supported public-link activity, but never the visitor's identity. Do not claim that Lowk+ or any other feature can identify a person when the app says it cannot. Context outside lowk may still allow someone to make their own guess, and we cannot guarantee that another user will not infer who participated.
6. Public links
You may share your lowk profile or ballot link. Anyone with the link may be able to view the public page and submit an eligible vote or written response without creating an account. Written responses are delivered substantially as submitted, subject to formatting and safety controls. You are responsible for where and how you share your link. Do not use a link to mislead, harass, track, or solicit prohibited content from another person. We may limit, disable, investigate, hide, or remove public links and submissions to prevent abuse.
7. School forum
Lowk may provide a school-based forum where eligible users can create posts, comments, photos, polls, links, votes, and reposts. Forum content is attributed to the school or an anonymous commenter label rather than displaying the author's account identity to other users. Anonymous does not mean unaccountable: TallyHQ keeps the internal account relationship needed to prevent abuse, apply limits, investigate reports, comply with law, and enforce these Terms.
Forum content may be ranked, reordered, quoted, reposted, or shown to other eligible members of the school community. Other people may copy or screenshot content, so do not post anything you expect to remain confidential. Deleting a post does not necessarily delete another user's repost, quote, report record, or copy. Forum reach, eligibility, ranking, and available formats may change as the service develops.
8. Invitations and messages
When lowk offers a server-sent invitation, tapping Invite confirms that you know that person and have their permission to receive the message. The recipient is told that someone invited them, but lowk does not identify which member sent the invitation. Invitations are one-time, non-marketing messages subject to daily limits, recipient cooldowns, and suppression controls. You may not use invitations for bulk messaging, strangers, harassment, promotion, or evading STOP requests. Message and data rates may apply. Recipients may reply STOP to suppress lowk-sent messages or HELP for support guidance.
Lowk may separately open Apple's editable Messages composer. If you choose to send that message, it is sent from your own Messages account and you are responsible for it. Opening or completing a native composer does not mean lowk or a carrier guarantees delivery or reading.
Authentication codes are security messages requested by the account holder and are separate from social invitations. Never ask another person to give you their authentication code.
9. Your content and conduct
You retain ownership of forum posts, comments, photos, public-link responses, profile photos, reports, feedback, and other content you provide. You grant TallyHQ a non-exclusive, worldwide, royalty-free license to host, reproduce, modify for formatting, display, distribute, and create technical copies of that content as reasonably needed to operate, secure, moderate, and improve lowk. You represent that you have the rights and permissions needed to provide the content and grant this license. This license ends when the content is deleted, except where it remains in another user's permitted repost or where copies are reasonably retained for security, legal, backup, or moderation purposes.
You may not use lowk to:
- Harass, threaten, shame, exploit, sexualize, or endanger another person.
- Encourage self-harm or violence, bully someone, publish private information, or make credible threats.
- Impersonate someone or upload deceptive, hateful, sexually explicit, illegal, or infringing content.
- Create, request, possess, or distribute sexual content involving anyone under 18.
- Target children under 13 or solicit personal, sexual, financial, or authentication information.
- Spam, scrape, reverse engineer, disrupt, probe, or bypass technical or safety controls.
- Buy, sell, transfer, or artificially inflate accounts, flames, votes, coins, boosts, or subscriptions.
- Use lowk for advertising, commercial solicitation, surveillance, or unlawful activity.
10. Safety, reports, and enforcement
You can block users; hide or report flames; report accounts, impersonation, forum posts, comments, and other supported content; and block the sender of an eligible flame without receiving that sender's internal identity. Hiding or reporting forum content removes it from your view. It does not automatically remove the content for everyone else. TallyHQ may remove content globally or restrict an account after review.
We use technical rules and human review to support moderation, but no filter or review process can detect every harmful, false, or prohibited item. We aim to review submitted reports within 48 hours. That target is not a promise that every report will result in removal or that every review will be completed within that period. Depending on the circumstances, we may leave content in place, limit its distribution, remove it, preserve it as evidence, warn or restrict a user, suspend an account, or permanently terminate access.
We may act without advance notice in urgent or serious situations and may prioritize reports based on apparent risk. Blocking prevents supported discovery and interaction in both directions but cannot control screenshots, messages sent outside lowk, or information another person already possesses. Lowk is not an emergency service. Contact 911 or appropriate local emergency services if someone is in immediate danger.
11. Lowk+, coins, and boosts
Lowk+
Lowk+ is an automatically renewing subscription purchased through Apple. The app displays the current price and billing period before purchase. Payment is charged to your Apple Account, and the subscription renews unless you cancel through Apple's subscription settings before renewal. Apple manages billing, cancellation, and refund requests under its policies. Deleting lowk does not automatically cancel a subscription.
Lowk+ benefits may include limited reveals, hints, Ghost Mode, double coin rewards, crush alerts, or public-link details such as server receipt time, approximate city/region/country, coarse device category, and anonymous link-view details. Availability may vary by account, platform state, or region. A subscription never makes Ghost Mode votes, nominations, or public-link identities revealable.
Coins and boosts
Coins are virtual items used only inside lowk. They have no cash value, are not property or legal tender, and may not be sold, transferred, exchanged, or redeemed for money. Coins may be earned, granted, or purchased as Apple consumables. Server records control the valid balance and resolve duplicate, refunded, or revoked transactions.
A random boost increases opportunities for your name to appear in eligible friends' polls. A targeted boost increases opportunities to appear in an eligible friend's poll. A boost does not create a friendship, override a block, guarantee placement, guarantee selection, or reveal who purchased it. Unused placements may expire or be canceled when eligibility changes. Except where required by law or Apple's policies, spent coins and completed boosts are not refundable.
12. Deactivation, deletion, and termination
You may take a break, log out, or initiate permanent account deletion through the app. Permanent deletion is irreversible and removes the account's profile, friendships, flames, gameplay, forum authorship and content, coins, boosts, and related information through our deletion process, subject to permitted reposts and limited legal, safety, transaction, and suppression records described in the Privacy Policy. You are responsible for canceling any Apple subscription separately.
We may suspend or terminate lowk, an account, or a feature when reasonably necessary. Sections that by their nature should survive—such as ownership, payment history, disclaimers, liability, and dispute terms—continue after termination.
13. Intellectual property and feedback
Lowk's software, branding, curated prompts, designs, and service content are owned by TallyHQ or its licensors and protected by law. These Terms give you a personal, limited, revocable, non-transferable license to use lowk for its intended purpose. If you provide feedback, you allow us to use it without restriction or compensation, but we do not acquire ownership of your other content merely because you submit it through lowk.
Copyright notices may be sent to [email protected]. A notice should include your physical or electronic signature; identification of the copyrighted work; identification and location of the allegedly infringing material; your name, address, telephone number, and email address; a statement of good-faith belief that the use is not authorized; and a statement, under penalty of perjury, that the notice is accurate and that you are authorized to act for the copyright owner. We may remove or restrict material and terminate repeat infringers where appropriate. If your content is removed because of a copyright notice, contact us for information about any available counter-notice process. Knowingly submitting a materially false notice may expose you to liability.
14. Third-party services
Lowk relies on services provided by Apple and other vendors and may link to third-party apps or sites such as Instagram, Snapchat, or Messages. Their terms and privacy practices govern your use of their services. We are not responsible for third-party availability, content, accounts, or actions. Apple is not a party to these Terms, does not operate lowk, and is not responsible for maintenance, support, claims, or warranties concerning lowk, except as required by Apple's own terms or applicable law. Apple and its subsidiaries are third-party beneficiaries of this section and may enforce it.
15. User content and service risks
Content and opinions submitted by users or public-link visitors belong to those people, not TallyHQ. We do not endorse, verify, or guarantee user content, identities, schools, statements, polls, links, advice, or conduct. To the maximum extent permitted by law, you assume the risks of interacting with other people and viewing, relying on, sharing, or responding to user content. You are solely responsible for content you submit and for your interactions on and off lowk.
TallyHQ may, but is not obligated to, monitor, screen, investigate, preserve, disclose, restrict, or remove user content except as required by applicable law. Moderation decisions involve judgment, and we do not guarantee that all objectionable content will be identified or removed, or that content you consider acceptable will remain available.
16. Disclaimers
To the maximum extent permitted by law, lowk is provided "as is" and "as available." TallyHQ disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not guarantee forum or poll availability, candidate placement, votes, flames, user conduct, user-content accuracy or safety, social outcomes, identity guesses, subscription availability, message delivery, or preservation of every item of content. Some jurisdictions do not allow certain disclaimers, so portions of this section may not apply to you.
17. Limitation of liability
To the maximum extent permitted by law, TallyHQ and its directors, officers, employees, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, profits, goodwill, or opportunities arising from lowk, including user content, another person's conduct, moderation decisions, unauthorized access, or interactions that occur through or outside the service. Our aggregate liability for claims relating to lowk will not exceed the greater of the amount you paid TallyHQ through lowk during the 12 months before the claim or 100 US dollars. These limitations do not apply where prohibited by law or to liability that cannot lawfully be limited.
18. Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless TallyHQ and its directors, officers, employees, and providers from third-party claims, losses, liabilities, damages, judgments, costs, and reasonable legal fees arising from your content, your conduct, your violation of these Terms or applicable law, or your infringement of another person's rights. This section does not require indemnification for TallyHQ's own unlawful conduct and does not apply where prohibited by law.
19. Governing law and disputes
Delaware law governs these Terms without regard to conflict-of-law principles. Subject to any non-waivable rights you have under applicable law, disputes must be brought in the state or federal courts located in Delaware, and you consent to their jurisdiction. Before filing a claim, you and TallyHQ agree to make a good-faith effort to resolve it by written notice. Nothing here prevents either party from seeking urgent injunctive relief or using an eligible small-claims court.
20. Changes and general terms
We may update these Terms as lowk changes. We will post updated Terms and revise the date above. If a change materially affects your rights, we will provide additional notice or request renewed agreement when required. If you do not agree to an update, you must stop using lowk and may delete your account.
These Terms and the Privacy Policy are the complete agreement concerning lowk unless another written agreement expressly applies. If one provision is unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our permission; we may transfer them as part of a merger, acquisition, reorganization, or sale of assets.
